Terms of service

1. What NetMarket is

NetMarket (“NetMarket”, “we”, “us”) is an online software service at netmarket.app. It runs a prediction game in which players use service credits called Netkens to back and trade on how public YouTube channels grow. Channel statistics come from the public YouTube Data API.

NetMarket is a Software-as-a-Service product. We are not a gambling operator, bookmaker, casino, exchange, broker, bank, payment institution or investment firm, and we are not licensed as any of those. These terms are the agreement between you and us for using the service.

2. Netkens are service credits, not money

A Netken (“NTK”, shown as Ñ) is a unit of service credit that lets you take part in the game. Netkens:

We do not offer withdrawals. If we ever add a way to redeem credits, it will only be after we hold the licences the law requires, it will be announced on the homepage first, and it will be governed by terms you will need to accept separately. Nothing in these terms promises that day will come.

3. A game of skill, not gambling or investing

Outcomes on NetMarket depend on your judgement about creators and on what other players do. Prices in a market are set purely by supply and demand among players on an automated pool; we do not set prices, take the other side of your trades for our own account, or promise any level of liquidity.

Nothing on NetMarket is financial, investment, tax or legal advice. No result, return or profit of any kind is promised or implied. Past movements say nothing about future ones. You can lose all the credits you commit to any founding round, position or contract, and you should only commit credits you are content to lose in a game.

4. Who can play

5. Your account

You sign in with a link we email to you. Anyone who can read your email can use your account, so keep that mailbox secure. Sign-in links work once and expire after 10 minutes; sessions last up to 30 days and can be ended by signing out or by closing the account. You can be signed in on more than one device.

Give us accurate information and keep it current. We may ask you to verify your identity or age at any time and may suspend the account until you do. You are responsible for everything done through your account.

6. Buying Netkens and refunds

You can buy Netkens by card through our payment provider, Stripe. Before you pay you see the amount, the exchange rate, our purchase fee and the exact number of Netkens you will receive. Purchases are in euro; minimum and maximum amounts are shown on the wallet page and may change.

Netkens are delivered the moment your payment succeeds and can be used immediately. By buying, you expressly ask us to deliver them straight away and acknowledge that, once delivered, the purchase is complete and any statutory right of withdrawal (“cooling-off period”) no longer applies, to the extent the law allows. Netkens are non-refundable once credited, whether or not you have used them, except where the law requires otherwise or we choose to make an exception.

Promotional credits (for example a first-purchase bonus) are a gift, have no value, and are reversed together with the purchase they came with.

Refunds and card disputes. If the money for a purchase goes back to you, whether we refund it or you dispute the payment with your card issuer (a “chargeback”), the Netkens that purchase credited, and its bonus, are reversed in the same proportion. Credits you have already spent are not pulled back out of markets; instead the uncovered amount is recorded as a balance you owe, which your next purchase pays off first. While a balance is owed or a dispute is open, the account is on hold: you can sign in and see everything, but not trade, and no new card payments are taken during an open dispute. If the dispute is resolved in our favour the reversal is undone; if it is upheld, the account is closed to play. Referral rewards earned from trades paid for with reversed money are withheld. Please contact us before disputing a charge: we would rather fix it.

7. Fees

The service is paid for by fees taken in Netkens. The current schedule, which we may change with notice on the site:

Fees are final and are not refunded when a position loses value.

8. Founding rounds

A listed creator’s market opens once its founding round reaches its threshold (normally Ñ 5,000). Credits put into a founding round become that market’s insurance fund, which backs trades once the market is live. Founding stakes are not returned, are not refunded if the round never fills, and do not buy shares. What a founder receives is the Founding Trader badge and the market itself. No single player may supply more than 20% of a round. We may adjust a threshold, open a market ourselves, or withdraw a listing; in the last case we will credit founders back their stakes.

9. Markets and trading

10. Holds on credits

Some credits (purchases, sale proceeds, commissions) show a hold of four to seven days in your wallet. The hold is a fraud-control measure and a placeholder for a possible future redemption feature. It does not stop you from using those credits in the game.

11. Referrals and copy trading

You may share your referral link. If someone signs up through it within 30 days of clicking, you receive 1% of their first hundred qualifying trades (of Ñ 5 or more) as Netkens, paid daily after fraud checks. Referral rewards are withheld where the two accounts appear to belong to the same person, refer each other, or otherwise game the programme. Referral rewards are Netkens and subject to everything in section 2.

Copy trading mirrors another player’s trades into your account automatically, with the sizing and fees shown when you enable it. The player you copy is not your adviser and owes you nothing; you accept every copied trade as your own. You can stop copying at any time.

12. Fair play

You agree not to:

13. Suspension and termination

We may suspend or close your account, cancel trades and forfeit credits if you break these terms, if we are required to by law or a payment provider, or if we reasonably believe your use puts other players or the service at risk. Where practical we will tell you why. You may end this agreement at any time by closing your account (section 14).

14. Closing your account and what we keep

You can close your account from your profile page once every position, option and open founding contribution is settled. On closure your remaining Netkens are forfeited (they have no cash value), your email, name, avatar and bio are erased, and your sessions are ended.

We keep the anonymised trading ledger and fee records for as long as accounting, tax and anti-fraud rules require (up to ten years), together with any records needed for an open dispute. Our privacy policy explains what we hold and why.

15. Responsible play

NetMarket is meant to be fun. Set yourself a budget of credits before you play and keep to it. If you want a break, you can ask us to lock your account for a period, or close it. If playing is causing you or someone close to you difficulty, please read our responsible play page, which lists free, confidential help lines.

16. Availability, changes and no warranty

We provide the service as it is and as available. We do not promise it will be uninterrupted, error-free, or that YouTube figures will be accurate or timely. We may change, suspend or stop any feature or the whole service. If we stop the service, we will give reasonable notice and will not owe you the cash value of any credits, because they have none.

17. Limits on our liability

To the extent the law allows, we are not liable for loss of credits, loss of expected winnings, loss of data, or indirect or consequential loss, and our total liability to you for all claims in any twelve-month period is limited to the fees you paid us in that period. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law. If you are a consumer, you keep every statutory right that cannot be waived.

18. If something goes wrong

Tell us first: email [email protected] with your account email and what happened. We aim to reply within five working days and to resolve the matter within thirty. Most problems (a trade at a wrong price, a missing credit) are fixed from the ledger. If we cannot agree, either of us may take the matter to the courts named in section 19. If you are a consumer, you may also use the courts of the place where you live.

19. Governing law

These terms are governed by the law of the country in which the operating company of NetMarket is established, and disputes go to the courts of that country, without prejudice to consumer rights that apply where you live. The company name, registered address and jurisdiction will be published on this page as soon as the operating structure is finalised; until then, contact us at the address in section 21 for any legal notice.

20. Changes to these terms

We may update these terms. Material changes are announced on the homepage at least 14 days before they take effect, and the version date at the top of this page changes. If you keep using the service after the new date, the new terms apply. If you do not agree, close your account before then.
